We, the Afghans living in Wiesbaden, have decided to establish an association in Wiesbaden that pursues only cultural and traditional, but no political, goals.
We aim to convey our cultural values and norms to young Afghans within a community and to support people and families in need.
1.1. The association shall be named "Afghan Cultural Association Wiesbaden and Surroundings."
1.2. The association is based in Wiesbaden.
1.3. The association was founded in 2007 and will be registered in the Wiesbaden Association Register.
The association adheres to Islam.
The association pursues exclusively and directly charitable purposes in the sense of the section "tax-privileged purposes" of the German Tax Code.
4.1. The association promotes a sense of home through events following Afghan traditions, which should also be attended by German citizens to foster intercultural understanding.
4.2. The association supports the education of Afghan children and youth living in Germany by offering lessons in both Afghan and German languages to facilitate their integration into German society.
4.3. The association fosters social, cultural, and religious concerns of Afghans living in Germany, aiming to preserve Afghan traditions alongside German values and norms and make them accessible to locals.
4.4. The association advocates for human rights.
4.5. It provides financial, technical, and logistical support for aid projects in Afghanistan in the spirit of self-help.
The association's statutory purposes are realized through:
5.1. Establishing meeting places for cultural and religious events for Afghan and German citizens, such as lectures on Afghan/German history and traditions.
5.2. Conducting educational and language courses in German and Afghan, particularly for children and the elderly.
5.3. Collaborating with charitable organizations and human rights associations.
5.4. Collecting material and monetary donations for Afghan-German aid projects.
6.1. The association operates altruistically and does not pursue its own economic interests.
6.2. The association's funds may only be used for statutory purposes. Members do not receive any financial benefits from association funds.
6.3. No person shall be favored through expenditures unrelated to the association's purpose or through disproportionately high compensation.
6.4. In the event of dissolution or termination of the association or loss of its purpose, the association's assets shall be used exclusively and directly for charitable purposes. The members' assembly shall determine the specific purpose, subject to approval by the relevant authority.
7.1. Any natural person who has reached the age of seven may become a member.
7.2. Persons who have submitted a written membership application to the board and signed the membership application form of the association, as well as paid the membership fees, can become members.
For persons with limited legal capacity, particularly minors, the application must also be signed by their legal representative.
8.1. Membership ends upon the member's death.
8.2. Membership ends upon voluntary resignation.
8.2.1. Resignation must be declared in writing to the board. For persons with limited legal capacity, particularly minors, the resignation declaration must also be signed by their parents or legal representatives.
8.2.2. Resignation can only be declared at the end of a financial year, with a notice period of one month.
8.3. Membership ends through expulsion or revocation of membership.
8.4. A member shall be expelled if they violate the association's statutes.
8.5. Revocation of membership requires approval by a simple majority of the members' assembly.
9.1. Members are obligated to pay a monthly contribution of at least 20 Euros.
9.2. To finance special projects or address financial difficulties of the association, levies may be imposed. The members' assembly decides on the levies.
10.1. The members' assembly consists of all members and is the highest decision-making body of the association.
10.2. Each member has one vote. A member may authorize another member in writing to exercise their voting right.
10.3. The members' assembly is responsible for determining membership fees, electing and dismissing board members, and making decisions regarding amendments to the statutes and dissolution of the association.
10.4. The ordinary members' assembly shall be held at least once a year, preferably in the first quarter. The board shall convene the meeting in writing with a four-week notice period and an agenda.
10.5. The meeting shall be chaired by the chairman or, in their absence, by the deputy chairman.
10.6. The members' assembly is quorate if more than half of the regular members are present. If a quorum is not met, the board must convene a second members' assembly within six weeks with the same agenda, which shall be quorate regardless of the number of members present.
10.7. Resolutions are passed by a simple majority of valid votes cast.
10.8. Resolutions must be recorded in writing and signed by the secretary or, in their absence, by a board member.
10.9. The members' assembly elects the board, advisory board, and auditors.
The board consists of five members:
The board is responsible for all matters of the association unless assigned to another body by the statutes.
The board is elected by the members' assembly for a two-year term. Its term begins with the election and ends after two years or upon election of a new board.
Board members must be regular members of the association.
Each board member has individual authority to represent the association. However, for financial transactions, the signatures of the chairman and treasurer are required.
The board's work is honorary and unpaid. However, travel expenses incurred due to association activities may be reimbursed.
The advisory board consists of three members elected for two years by the members' assembly.
It monitors the board's work and may convene an extraordinary members' assembly.
Two auditors are elected by the advisory board.
They audit the association's finances and submit a report at the general assembly.
11.1. The association may be dissolved by a 2/3 majority vote of regular members at a members' assembly.
11.2. In the event of dissolution, its assets shall be transferred to the German Red Cross in Wiesbaden for charitable, benevolent, or ecclesiastical purposes.
